The Town of Mosman Park is seeking community feedback on proposed Local Planning Policy No. 49 – Exemptions from Development Approval and Temporary Development (LPP49).

This new policy aims to make the planning process simpler and more efficient by identifying certain types of minor development that will no longer require development approval, provided they meet the policy requirements.

Why is this policy being introduced?

Currently, even very small variations to development standards often require a development application, despite having little or no impact on neighbouring properties or the surrounding streetscape.

The proposed policy seeks to:

  • streamline the planning approval process;
  • reduce unnecessary red tape;
  • provide greater certainty for homeowners, builders and designers;
  • allow Planning Officers to focus on more complex development proposals; and
  • support efficient housing delivery while maintaining the Town's amenity and built form expectations.

What does the policy cover?

The draft policy proposes exemptions for minor forms of development where planning impacts are considered negligible with regard to amenity and built form.

Examples include:

  • Minor variations to residential setbacks.
  • Small reductions in required open space.
  • Minor site works.
  • Temporary structures associated with construction.
  • Internal works to commercial buildings.
  • Replacement signage.
  • Temporary viewing platforms.
  • Solar collectors and water tanks.

The policy also outlines circumstances where exemptions will not apply, including development affecting heritage places, or proposals likely to adversely impact neighbouring properties or the streetscape.

What won't change?

This policy only relates to development (planning) approval.

Other approvals may still be required, including:

  • Building Permits;
  • Heritage approvals;
  • Approvals under other legislation; and
  • Any other applicable statutory requirements.

The policy does not remove these obligations.

The Town invites residents, landowners, businesses and other interested stakeholders to provide feedback on the draft Local Planning Policy.

Your comments will help Council consider whether the proposed exemptions strike the right balance between reducing unnecessary approvals while protecting neighbourhood amenity and the character of Mosman Park.
