Update of 8/10/2024

Council, at their OCM of 24 September 2024, resolved to approve proposed Scheme Amendment No. 10 to Local Planning Scheme No. 3. All applicable documentation has now been forwarded to the Department of Planning, Lands, and Heritage for final review and determination.

Proposed Standard Scheme Amendment no.10 - Omnibus Amendment to Local planning scheme no.3

The Town has undertaken a review of the land use permissibility allowed within each zone. Following on from the review, the Amendment has been initiated to address inconsistencies with State Planning Legislation and to fix potential 'gaps' within the Scheme.

The purpose of the Amendment is to modify the current Zoning Table (Table 3) within the Local Planning Scheme No.3 (Scheme) to include land uses that have not been listed as per the land use definitions within the Planning and Development (Local Planning Schemes) Regulations 2015 (Regulations). The Amendment seeks to add new land uses such as ‘Holiday House’ and ‘Holiday Accommodation'.

The Amendment also intends to update current land use permissibility to reflect current state planning frameworks and ensure that appropriate land uses continue to be situated within appropriate locations.

Land uses and their permissibility have the potential to have a significant impact upon the built environment and amenity of an area, and it is considered important that the Town continues to address and update controls afforded by the Scheme.

The Amendment proposes to update the Scheme by modifying Table 3 in the following ways:

  1. Changing the land use permissibility of ‘Commercial Vehicle Parking’ in the ‘Commercial’ Zone from a (P)-Permitted land use to (X)-Not Permitted and from an (A)-Advertised land use in the Centre’ Zone to (X)-Not Permitted.
  2. Changing the land use permissibility of ‘Dwelling-Single House’ in the ‘Centre’ Zone from (D)- Discretionary to (X)- Not Permitted.
  3. Adding the land use of ‘Holiday Accommodation’ into the Table and applying the land use permissibility of (A)-Advertised within the ‘Residential’, ‘Commercial’, ‘Mixed-Use’, and ‘Centre’ Zones.
  4. Adding the land use of ‘Holiday House’ into the Table and applying the land use permissibility of (A)-Advertised within the ‘Residential’, ‘Commercial’, ‘Mixed-Use’, and ‘Centre’ Zones.
  5. Changing the land use of ‘Home Business’ in the ‘Mixed-use’ Zone from (P)-Permitted to (D)-Discretionary.
  6. Changing the land use permissibility of ‘Recreation- Private’ in the ‘Commercial’ Zone from (X)- Not Permitted to (D)-Discretionary.
  7. Changing the land use permissibility of ‘Family Day Care’ in the ‘Commercial’ Zone from (X)- Not Permitted to (A)-Advertised.
  8. Changing the land use permissibility of ‘Residential Aged Care’ in the ‘Commercial’, and ‘Centre’ Zones from (X)-Not Permitted to A-Advertised.
  9. Changing the land use permissibility of ‘Consulting Rooms’ in the ‘Residential’ Zone from (X)-Not Permitted to (A)-Advertised.
  10. Changing the land use permissibility of ‘Club Premises’ in the ‘Commercial’ Zone from (P)-Permitted to (D)-Discretionary.

Public Consultation:

The Amendment will be advertised for a period of 42 days from the 28th of June - 9th August 2024. Comments on the Amendment can be lodged by completing the survey found in the link below. The following documents are available for consideration:
